Terms of Use

1. Acceptance of terms
Welcome to Fire Cert Academy, LLC (“Company,” “we,” “us,” or “our”). By accessing or using our website at firecertacademy.com (the “Site”) and services (the “Services”), including training materials and practice tests for NICET and related fire protection industry exams, you agree to comply with and be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use our Services.
2. Changes to these terms
We may modify these Terms at any time. Changes become effective when posted on the Site. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms. The “Effective date” above reflects the most recent revision.
3. Eligibility
You must be at least 18 years old to use our Services. By using the Services, you represent that you meet this requirement.
4. Accounts and credentials
Some parts of the Services require an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us promptly through our contact page if you suspect unauthorized access. Accounts are non-transferable and may not be shared.
5. Subscription and payment
Most of the Services are offered on a subscription basis. By subscribing, you authorize us and our payment processor (currently Stripe, Inc.) to charge the payment method on file for the applicable recurring fee until you cancel. Subscriptions renew automatically at the end of each billing period. You can cancel a subscription at any time from your account page. Refunds are governed by our Refund & Cancellation Policy.
6. License and restrictions
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the training materials, practice tests, explanations, and other content on the Site solely for your personal, non-commercial exam preparation. You may not (a) copy, reproduce, distribute, publicly display, or publish any portion of the content outside the Site; (b) share your account credentials or let another person use your account; (c) scrape, crawl, or otherwise extract questions, answers, or explanations by automated means; (d) use the content to train a machine learning model or build a competing product; or (e) remove or obscure any copyright, trademark, watermark, or other proprietary notice.
7. No affiliation with NICET, NFPA, or other certifying bodies
Fire Cert Academy, LLC is not affiliated with, endorsed by, or sponsored by NICET, NFPA, or any other certifying body. Our materials are independently developed to help candidates practice and are not the actual exam questions. Trademarks referenced on the Site are the property of their respective owners.
8. User responsibilities and acceptable use
You agree to use the Services only for lawful purposes and in compliance with these Terms. You will not (a) use the Services in any way that could disable, overburden, damage, or impair them; (b) attempt to gain unauthorized access to any part of the Site, other accounts, or connected systems; (c) upload or transmit viruses or malicious code; or (d) use the Services to harass, defame, or harm any person.
9. Intellectual property
All content on the Site — including text, graphics, logos, question banks, explanations, software, and design elements — is owned by or licensed to Fire Cert Academy, LLC and is protected by copyright, trademark, and other intellectual property laws. Unauthorized use is prohibited. Nothing in these Terms grants you any right, title, or interest in our intellectual property.
10. Disclaimer of warranties
The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that they will cause you to pass any certification exam.
11. Limitation of liability
To the fullest extent permitted by law, Fire Cert Academy, LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim arising from or related to these Terms or the Services will not exceed the amount you paid us in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Fire Cert Academy, LLC and its officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of any third-party right.
13. Termination
We may suspend or terminate your access to the Services at our discretion, with or without notice, if you violate these Terms or if we believe your use may harm the Services or other users. You may stop using the Services at any time. Sections 6, 9, 10, 11, 12, and 14 survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration in North Carolina, unless otherwise required by applicable law. You agree to resolve disputes only on an individual basis and waive any right to bring a class action.
